1. Nature of the Service

OnlyEnable provides software tools and expert-led consulting services related to web accessibility ("Services"). The Services are a tool to assist you in your accessibility efforts — they are not a guarantee of compliance with any law or standard, including but not limited to the Americans with Disabilities Act (ADA), WCAG, Section 508, or any state or local accessibility regulation.

2. No Warranty of Legal Compliance

You acknowledge and agree that: (a) no software widget or audit can guarantee full accessibility or legal compliance; (b) accessibility is an ongoing process, not a one-time fix; (c) compliance with any accessibility law or standard depends on your specific website, content, and operations; (d) we make no representations that using our Services will prevent lawsuits, demand letters, or regulatory actions.

We explicitly disclaim any warranty of fitness for legal compliance. If you have specific legal concerns, consult a qualified attorney.

3. Customer Responsibility

You remain fully responsible for your website's content, code, and overall accessibility. Our Services provide tools, recommendations, and expert reviews — you and your team must implement any fixes and maintain ongoing compliance efforts.

4. Limitation of Liability

To the maximum extent permitted by law, our total cumulative liability for any claim arising out of or related to the Services is limited to the fees you paid us in the twelve (12) months preceding the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, legal fees, settlement costs, or regulatory penalties.

5. Marketing Claims

Our marketing materials describe our Services. We do not and will not claim "100% compliance," "lawsuit protection," or similar absolute legal outcomes. If you see such a claim attributed to us, it is not authorized.

6. Service Availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance, emergency updates, and unforeseen outages may occur.

7. Data & Privacy

We comply with applicable data protection laws. See our Privacy Policy for details on how we collect and use data. Widget usage analytics use hashed IP addresses for privacy.

8. Subscription & Billing

Subscriptions auto-renew until canceled. Cancellations take effect at the end of the current billing period. No refunds for partial periods. Free trials convert to paid unless canceled before the trial ends.

9. Changes to Terms

We may update these terms with 30 days' notice via email. Continued use after the notice period constitutes acceptance.

10. Governing Law & Disputes

These terms are governed by the laws of [Governing Jurisdiction — to be set by your attorney]. Disputes will be resolved through binding arbitration. You waive any right to class action participation.
